Firm successfully moves case to New York and defeats copyright infringement claims

After successfully moving to transfer the case from the federal court in the Northern District of Illinois to the Southern District of New York, Jonathan D. Davis, P.C. won a motion to dismiss plaintiffs' copyright infringement claims based on a hit song of its client.

The Court found no substantial similarity existed between the music, lyrics, and other elements of plaintiffs' song and the challenged song. Having dismissed the infringement claim, the Court declined to exercise supplemental jurisdiction over plaintiffs' state law breach of contract claim.
