Firm defeats motion to stay band manager's lawsuit to recover commissions

Jonathan D. Davis, P.C., filed a lawsuit in the federal court for the Southern District of New York on behalf of an artist manager seeking to recover commissions due under a management agreement with members of the band The Red Jumpsuit Apparatus. Rather than contest the lawsuit on the merits, the band filed a motion to stay the action pending the resolution of a parallel proceeding the band brought in California. The Court swiftly denied the motion, rejecting each of the arguments the band made to support its abstention arguments.
