Firm obtains dismissal of defenses alleged against luxury brand in trademark lawsuit

In an action brought in the federal court for the Southern District of New York on behalf of a luxury goods company to protect its valuable trademarks and products, Jonathan D. Davis, P.C. successfully obtained the dismissal of multiple affirmative defenses asserted by the alleged infringer. In response to the motion to dismiss, which was filed on behalf of our clients, the Court struck the defendants' defenses for estoppel, implied license, acquiescence, laches, waiver, copyright misuse, unclean hands, and failure to mitigate damages defenses, finding them insufficient as a matter of law.
